Terms of Sales
These general terms and conditions of sale (abbreviated to GTCS)
govern the relationship between PLANET MOTORSPORT and its customers.

Orders
1- Our prices are net including VAT, while stocks last. Prices are subject to change.
2- The various items shown in our catalogs are for guidance only and their characteristics may be modified by our suppliers. A dated and signed order constitutes a firm offer to purchase. Catalog photos are not contractual and serve only to identify items.
3- For equipment not in stock (specified on the day of the order), the delivery time will be given as an indication. If delivery is not immediate, and if the planned delivery date is exceeded by more than 7 days, not due to force majeure, the customer may cancel the sales contract by registered letter with acknowledgement of receipt. In this case, the contract is considered terminated on receipt of the registered letter with acknowledgement of receipt by which the customer informs the seller of his decision, if delivery has not taken place between the sending and receipt of this letter.
The customer may exercise this right within 60 working days of the date indicated for delivery of the product ordered.
EXCHANGES AND RETURNS
a) Delivery error:

- Re-shipment at our expense
- We will resend the parcel once we have received the goods to be exchanged.
b) Customer error in order or unsuitable product (except made-to-measure or cut-to-length products where no returns are possible):
- Contact us on 02 51 12 02 78,
- You return the goods to us at your expense, using the carrier of your choice.
- Depending on your request, we can offer you :
- A credit note valid for any order placed within the next 12 months
- A direct refund
IN ALL CASES, PUT YOUR CONTACT INFORMATION AND RETURN MODIFICATION IN YOUR PACKAGE (with a copy of your invoice).

ALL RETURNED GOODS MUST BE IN NEW CONDITION SO THAT WE CAN PUT THEM BACK ON SALE.
It is the customer's responsibility to check that the product ordered conforms to the original order before assembling or using it.
Any goods already assembled or returned damaged will not be taken back and will be invoiced.
Product returns will be accepted up to 1 month after the delivery date.
GUARANTEE
The warranty is valid upon agreement with our supplier and is limited exclusively to the replacement of the product recognized as defective by the supplier or by us.
We accept no liability for improper use or faulty assembly.
Products in this catalog used in competition are the sole responsibility of the user, and are not covered by any warranty other than that for hidden defects.
Our products are exclusively intended for use in motor racing (unless otherwise specified). Any other use is the responsibility of the customer and does not engage the responsibility of the seller.
The seller is bound by the warranty for latent defects in the product sold which render it unfit for the use for which it was intended, or which impair this use to such an extent that the buyer would not have purchased it or would only have paid a lower price had he been aware of them, in accordance with the provisions of articles 1641 et seq. of the French Civil Code.
No warranty shall apply if the product sold has been modified without the prior written consent of the manufacturer, or if the product has been serviced or repaired by persons not authorized in writing by the manufacturer or seller, or if the product sold has been used under abnormal conditions with reference to the instructions supplied by the manufacturer.
Transport
Responsibility for transport lies with the purchaser, who must indicate to the carrier, on receipt of the parcel, on the delivery note, any reservations he deems necessary to note and confirm them within 24 hours by registered letter with acknowledgement of receipt to the carrier.
Packages travel insured for the value of the goods at the express request of the customer, who will bear the insurance costs without prior written agreement.
PROPERTY RESERVATION
PLANET MOTORSPORT intends to avail itself of the provisions offered by law 80 335, relating to the effects of the retention of title clause, the abandonment of deposits paid does not constitute cancellation of the order and therefore does not give rise to any reimbursement procedure with recourse to damages.
CATALOG ILLUSTRATIONS
Illustrations are not contractual and are only intended to enable the customer to identify an item.
We reserve the right to change product characteristics or brands without prior notice in order to improve our offer.
Total or partial use or reproduction is forbidden (law of March 11, 1957, article 40, paragraph 1).
Dispute
En cas de litige, seuls les tribunaux du lieu du siège social de PLANET MOTORSPORT seront compétents (RENNES).
LATE PAYMENT
Unless otherwise agreed, all payments must be made in cash at the time of order. Otherwise, any delay in payment or rejection of a draft will result in the opening of a dispute file invoiced at 18 euros inclusive of tax, as well as late payment penalties calculated on a weekly basis at the rate of 1.5 times the legal interest rate calculated from the invoice due date.
